Terms of Service for The Bare Home

Welcome to The Bare Home. These Terms of Service ("Terms") govern your access to and use of thebarehome.ca (the "Site"), our mobile applications (if any), and all products, services, content, and features offered through the Site or related channels (collectively, the "Services") provided by The Bare Home ("The Bare Home," "we," "us," or "our").

By accessing the Site, placing an order, creating an account, subscribing to services, or otherwise using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, you must not use the Services.

The Bare Home is powered by Shopify, which provides the online commerce platform enabling us to offer these Services. Any sales or purchases are transactions between you and The Bare Home. By using the Services, you release Shopify from any claims, damages, or liabilities arising from your transactions with us.

1. Eligibility

By agreeing to these Terms, you represent that you are at least the age of majority in your jurisdiction of residence (typically 19 in Canada or 18 elsewhere) and have the legal capacity to enter into binding contracts. You may not use the Services if you are a minor or lack such capacity.

2. Accounts

To purchase products, manage subscriptions, or access certain features, you may need to create an account. You agree to provide accurate, current, and complete information during registration and to update it promptly. You are responsible for maintaining the confidentiality of your account credentials and all activity under your account. Notify us immediately of any unauthorized use at info@thebarehome.ca. We reserve the right to suspend or terminate accounts at our sole discretion.

3. Products and Orders

All product descriptions, images, pricing, and availability are for informational purposes only and subject to change without notice. We strive for accuracy but do not warrant that product details will be error-free. Colors and appearances may vary due to device settings.

When you place an order, you make an offer to purchase. We reserve the right to accept, reject, or cancel orders for any reason, including pricing errors, availability, fraud suspicion, or compliance issues. Orders are not binding until confirmed by us via email. Review your order carefully before submission, as cancellations after acceptance may not be accommodated.

Returns, exchanges, and refunds are governed by our Refund Policy, which is incorporated herein by reference.

4. Pricing and Payment

Prices are in CAD, exclude taxes, shipping, duties, and fees unless stated otherwise, and are subject to change without notice. The price at order confirmation applies. You authorize us (via Shopify or payment processors) to charge your payment method for the total amount, including recurring charges for subscriptions.

You represent that you are authorized to use the payment method provided and that all charges will be honored. We reserve the right to require additional verification or payment methods.

5. Shipping and Delivery

Estimated delivery times are for guidance only. We are not liable for delays due to carriers, customs, weather, or force majeure events. Risk of loss passes to you upon delivery to the carrier. Inspect shipments promptly and report issues within 7 days.

6. Subscriptions

Certain products are offered as subscriptions via third-party providers like Recharge. Subscription terms, including billing frequency, modifications, pauses, skips, and cancellations, are governed by Recharge's terms (available at their platform) and our Subscription Policy (if applicable). You authorize recurring charges until cancelled. We may adjust subscription prices with notice via email or account dashboard.

7. Intellectual Property

The Services, including text, graphics, logos, images, audio, video, and software, are owned by us, Shopify, or licensors and protected by copyright, trademark, and other laws. You receive a limited, non-exclusive, non-transferable, revocable license for personal, non-commercial use only. No other rights are granted. Unauthorized use may violate law.

8. User Content and Feedback

Reviews, comments, photos, and submissions ("User Content") grant us a perpetual, worldwide, royalty-free, sublicensable license to use, modify, distribute, and display for any purpose. You represent you own all rights in User Content and it complies with these Terms. We may monitor, edit, or remove User Content at our discretion.

9. Prohibited Uses

You agree not to: (a) use the Services unlawfully; (b) infringe rights; (c) harass or harm others; (d) transmit malware; (e) scrape or use bots (except as permitted); (f) circumvent security; or (g) engage in fraudulent activity. We may suspend or terminate violators without notice.

The Services may integrate third-party tools (e.g., Shopify apps, payment gateways, Klaviyo SMS, Recharge). Your use is at your own risk, subject to their terms. We disclaim liability for third-party content or services.

Neither party is liable for delays or failures due to events beyond reasonable control, including acts of God, natural disasters, war, terrorism, pandemics, government actions, labor disputes, supply shortages, or carrier delays ("Force Majeure Events"). The affected party must notify the other promptly and resume performance as soon as practicable.

We may suspend or terminate your access at any time without notice for violation of these Terms or any reason. You may stop using the Services anytime. Obligations accrued prior to termination survive.

17. Governing Law and Disputes

These Terms are governed by the laws of Ontario, Canada, without regard to conflict principles. Any disputes shall be resolved exclusively in the courts of Burlington, Ontario. You consent to personal jurisdiction there. For claims under CAD 30,000, small claims court may apply.

Severability: Invalid provisions are severed; remainder remains effective.
Waiver: No waiver unless in writing.
Entire Agreement: These Terms constitute the full agreement.
Assignment: We may assign; you may not without consent.
No Class Actions: Claims must be individual.
